摘要在社会环境中，家庭作为社会的组成单元，是社会得以稳定发展的关键因素。就现阶段来看，我国正处于社会主义经济快速发展的阶段，而经济的快速发展给婚姻和家庭带来了不同的结果，很多家庭因为经济状况的改变，家庭环境氛围也得到了改善，很多家庭因为家庭经济的变化而去追求另外的生活，从而导致了离婚率的上升。当面对现阶段社会存在的问题时，法律范围内的离婚损害赔偿制度成为了人们热议的话题。本文针对我国的离婚损害赔偿制度进行了研究。首先，从我国离婚损害赔偿制度的性质和概念进行分析，并对离婚损害赔偿制度的意义和功能进行了阐述；继而，针对我国离婚损害赔偿制度的法律适用进行了分析，其中包括离婚损害赔偿构成的要件、离婚损害赔偿的主体分析以及离婚损害赔偿范围和赔偿数额三个方面；然后，对我国离婚损害赔偿制度的不足进行探讨；最后，针对离婚损害赔偿制度的不足提出了建议，进而对离婚损害赔偿制度进行完善。希望本文的相关研究能够为我国的离婚损害赔偿方面作出微薄的贡献。关键词：婚姻法；离婚损害；赔偿AbstractIn the social environment, family is the unit of society, and it is the main part of social stable development.
