代建项目的代建合同管理摘 要“代建制”管理解决了过去政府投资建设项目的责任主体不明、责任不清的问题，以合同的形式界定了出资者、建设管理者、使用者等当事人各自的责任、权利、义务，从质量、工期、造价及安全等方面入手，建立有效的激励和约束机制，从而使代建项目在既定的目标下顺利实施。由于“代建制”才刚刚实行,代建合同中还存在一些问题。本文以进一步完善我国代建合同为目的，首先将我国现行的四种典型代建模式下的代建合同与国内外相关合同进行比较分析，寻找出现行代建合同中存在的主要问题；然后针对这些问题，结合国外较成熟的相关合同管理经验和对我国典型案例的实证分析，提出从建立有效的竞争和激励约束机制、加强合同管理和实行工程担保和保险制度三个方面来进一步完善代建合同的方案。关键词：合同 代建制 合同管理 激励理论 Contract Management of Agent Construction ProjectABSTRACTThe management of agent construction system resolves the problems of indistinctly of responsible main body and unclear of responsibility in the past government investment construction.
