第1页共33页编号：时间：2021年x月x日书山有路勤为径，学海无涯苦作舟页码：第1页共33页人民币银行结算账户管理办法AdministrativeRulesforRMBBankSettlementAccounts中国人民银行令[2003]第5号颁布日期：20030410实施日期：20030901颁布单位：中国人民银行Decree[2003]No.5ofthePeople'sBankofChinaApril10，2003ChapterIGeneralProvisionsArticle1Theserulesareformulatedaccordingtothe“LawofthePeople'sRepublicofChinaonthePeople'sBankofChina”andthe“CommercialBankingLawofthePeople'sRepublicofChina”soastoregulatetheopeninganduseandstrengthenmanagementofRMBbanksettlementaccounts（hereinafterreferredtoas“banksettlementaccounts”）andsafeguardeconomicandfinancialstability.Article2TheserulesareapplicabletobanksettlementaccountsopenedbydepositorswithbanksdomiciledinChina.“Depositors”hereinafterrefertogovernmentagencies，socialorganizations，militaryunits，enterprises，publicinstitutionsandotherorganizations（referredasInstitutionshereinafter），self-employedentitiesandnaturalpersonsthatmaintainsettlementaccountswithbanksinChina.Banksintheserulesrefertopolicybanks，commercialbanks（includingwhollyforeign-fundedbanks，Sino-foreignjoint-equitybanksandbranchesofforeignbanks），urbanandruralcreditcooperativesthatareapprovedbythePeople'sBankofChinatoengageinpaymentandsettlementbusinessinChina.BanksettlementaccountsintheserulesrefertoRMBdemanddepositaccountsopenedbybanksfordepositorstoeffectpaymentandsettlementoffunds.Article3Banksettlementaccountsmaybeclassifiedonthebasisofthenatureofdepositorsintobanksettlementaccountsforinstitutionsandbanksettlementaccountsforindividuals.（1）Abanksettlementaccountopenedbyadepositorinthenameofaninstitutionisabanksettlementaccountforinstitution.Basedontheiruses，banksettlementaccountsforinstitutionsmaybedividedintobasicdepositaccounts，generaldepositaccounts，specialdepositaccountsandtemporarydepositaccounts.第2页共33页第1页共33页编号：时间：2021年x月x日书山有路勤为径，学海无涯苦作舟页码：第2页共33页Banksettlementaccountsopenedbyself-employedentitieswiththebrandoftheirproductsorthenameoftheownerappearedinthebusinesslicenseshallbemanagedasbanksettlementaccountsforinstitutions.（2）AbanksettlementaccountopenedbyanaturalpersondepositorwithhisorherIDisabanksettlementaccountforindividual.Bankingaccountsopenedbypostalsavingsinstitutionstoconductbankingcardbusinessshallbemanagedasbanksettlementaccountsforindividuals.Article4Adepositoropeningbanksettlementaccountsforinstitutionsmayonlykeeponebasicdepositaccountinbanks.Article5Depositorsshallopenbanksettlementaccountsintheplacewheretheyareregisteredorlocated，exceptforthoseallowedbytheserulestoopenbanksettlementaccountsoutsidetheirplacesofresidence（indifferentprovinces，citiesorcounties）。Article6Openingofbasicdepositaccounts，temporarydepositaccounts，oropeningofspecialdepositaccountsbybudgetunitsshallbesubjecttoreviewandapprovalofthePeople'sBankofChina.Withtheapproval，thebankthatistoholdtheaccountshallissuearegistrationcertificateofopeningofsuchanaccount.However，temporarydepositaccountsopenedbydepositorsforthepurposeofexaminationofregisteredcapitalrequirementcomplianceareexemptedfromsuchastipulation.Article7Depositorsmaymaketheirownchoicesofbankstoopenbanksettlementaccounts.Noinstitutionsorindividualsareallowedtocommanddepositorstoopenbanksettlementaccountswithdesignatedbanks，unlessstipulatedotherwisebylaws，administrati...
