姓名注册商标的法律规制分析与建议摘要：随着小康社会迈入决胜时期，以姓名为主要标志的商标经常被匆忙注册，这种侵权形式不仅复杂，而且多样。但是我国目前关于姓名注册商标的法律问题依然还没有明确的界定。并且，我国在商标行政争议中保护在先名权利的标准和条件在司法实践中并不十分明确。其中，声望较高的名人，他们的姓名商标侵权最为严重。而与国外相比，我国相对来说更需要在一定程度上规范名人姓名商标的注册和保护。本文从立法和监督审查的角度对姓名尤其是名人姓名商标的注册和监督进行规范。关键词：姓名注册; 商标; 保护; 法制;Analysis and suggestion on legal regulation of name registered trademarkAbstract: as the well-off society enters the decisive period, the trademark with the name as the main mark is often registered in a hurry. This infringement is not only complicated, but also diversified. However, there is still no clear definition on the legal issues of name trademark registration in China. Moreover, the standards and conditions for the protection of prior name rights in trademark administrative disputes in China are not very clear in judicial practice. Among them, the celebrity with high prestige, their name trademark infringement is the most serious. Compared with foreign countries, China needs to regulate the registration and protection of celebrities' names and trademarks to a certain extent.
