航运合同有关Laytime的注释ice-fying发表于2007-10-197:58:00对于很多航运合同中最敏感的条款应该是装卸时间计算的条款也就是laytime的问题，在这里主要应该是genconcharterparty个修订版本中的区别了，前两个版本1922/1976以及最新版本1994的条款内容写出来进公参考：1、GENCON1922/1976:LAYTIME:(a)SeparatelaytimeforloadinganddischargingThecargoshallbeloadedwithinthenumberofrunninghoursasindicatedinBox16,weatherpermittingSundaysandholidaysexcepted,unlessused,inwhicheventtimeactuallyusedshallcount.ThecargoshallbedischargedwithinthenumberofrunninghoursasindicatedinBox16weatherpermittingSundaysandholidaysexcepted,unlessused,inwhicheventtimeactuallyusedshallcount.(b)TotallaytimeforloadinganddischargingThecargoshallbeloadedanddischargedwithinthenumberoftotalrunninghoursasindicatedinBox16,weatherpermitting,Sundaysandholidaysexcepted,unlessused,inwhicheventtimeactuallyusedshallcount.(c)Commencementoflaytime(loadinganddischarging)Laytimeforloadinganddischargingshallcommenceat1p.m.ifnoticeofreadinessisgivenbeforenoon,andat6a.m.nextworkingdayitnoticegivenduringofficehoursafternoon.NoticeatloadingporttobegiventotheShippersnamedinBox17.Timeactuallyusedbeforecommencementoflaytimeshallcount.Timelostinwaitingforberthtocountasloadingordischargingtime,asthecasemaybe.indicatealternative(a)or(b)asagreed,inBox16.装卸时间(a)装货和卸货分别计算时间如果天气许可，货物应在第16栏规定的连续小时数内装完，星期日和节假日除外，除非已经使用，但只计算实际使用的时间。如果天气许可，货物应在第16栏规定的连续小时数内卸完，星期日和节假日除外，除非已经使用，但只计算实际使用的时间。(b)装货和卸货混合计算时间如天气许可，货物应在第16栏规定的总的连续小时数内装卸完毕，星期日和节假日除外，除非已使用，但只计算实际使用的时间。(c)装卸时间的起算如装卸准备就绪通知书在中午之前递交，装卸时间从下午1时起算，如通知书在下午办公时间递交，装卸时间从下一个工作日上午6时起算，在装货港，通知书应递交给第17栏中规定的托运人。装卸时间起算已实际使用的时间计为装卸时间。等待泊位所损失的时间计为装卸时间。协议选择(a)或(b)，并填入第16栏。2、GENCON1994：LAYTIME:*(a)SeparatelaytimeforloadinganddischargingThecargoshallbeloadedwithinthenumberofrunningdays/hoursasindicatedinBox16,weatherpermitting.Sundaysandholidaysexcepted,unlessused,inwhicheventtimeactuallyusedshallcount.Thecargoshallbedischargedwithinthenumberofrunningdays/hoursasindicatedinBox16weatherpermitting.Sundaysandholidaysexcepted,unlessused,inwhicheventtimeactuallyusedshallcount.*(b)TotallaytimeforloadinganddischargingThecargoshallbeloadedanddischargedwithinthenumberoftotalrunningdays/hoursasindicatedinBox16,weatherpermitting.Sundaysandholidaysexcepted,unlessused,inwhicheventtimeusedshallcount.(c)Commencementoflaytime(loadinganddischarging)Laytimeforloadinganddischargingshallcommenceat1300hours.ifnoticeofreadinessisgivenuptoandincluding1200hours,andat0600hoursnextworkingdayifnoticegivenduringofficehoursafter1200hours.NoticeofreadinessatloadingporttobegiventotheShippersnamedinBox17orifnotnamed,totheCharterersortheiragentsnamedinBox18.NoticeofreadinessatthedischargingporttobegiventotheReceiversor,ifnotknown,totheCharterersortheiragentsnamedinBox19.Iftheloading/dischargingberthisnotavailableontheVessel'sarrivalatorofftheportofloading/discharging,theVesselshallbeentitledtogivenoticeofreadinesswithinordinaryofficehoursonarrivalthere,whetherinfreepratiqueornot,whethercustomsclearedornot.Laytimeortimeondemurrages...
