工厂建造合同PLANTCONSTRUCTIONCONTRACT工厂建造合同“第一条定义业主指.“承包商指.“工厂指在附录times;中指定的构成固定设备的全部机器、设备和材料。“工地指按本合同用于建造工厂的全部地皮。“工程指承包商按本合同施行的工程。“合同价格指业主向承包商支付的全部工程款项。Article1-DefinitionsTheOwner“shallmean.TheContractor“shallmean.ThePlant“shallmeanalloranypartofthemachinery，equipmentandmaterialsformingthepermanentinstallationasspecifiedinAppendix（;）。TheSite“shallmeanallthelandwheretheplantistobeconstructedinaccordancewiththisContract.TheWorks“shallmeantheworkstobedonebytheContractorunderthisContract.TheContractPrice“shallmeanthetotalsumpayabletotheContractorbytheOwnerfortheWorks.第二条承包商的职责1.承包商应负责设计、筹划以及在工地上建造工厂。2.除了业主依照第times;条提供的工程和设备，承包商应提供所有为使工厂成功建造所必需的设备、材料、工具、设备、劳工和效劳。3.承包商应依照附录times;中的日程安排施工。4.承包商应依照附录times;中的规定为业主培训工厂设备的操作和维修人员。5.承包商应向业主提供附录times;中规定的备件。6.承包商应向业主提供附录times;中指定的维修设备。Article2-Contractor’sResponsibilities1.TheContractorshalldesign，engineer，andconstructthePlantattheSite.2.TheContractorshallprovideallequipment，materials，tools，facilities，labourandservicesnecessaryforthesuccessfulconstructionofthePlantexceptthoseitemsandfacilitiestobesuppliedbytheOwnerunderArticle（;）。3.TheContractorshallperformtheWorksinaccordancewiththeScheduleinAppendix（;）。4.TheContractorshallprovidetheOwner’spersonnelwithtrainingofoperationandmaintenanceofthePlantinaccordancewithAppendix（;）。5.TheContractorshallsupplytheOwnerwiththesparepartsspecifiedinAppendix（;）。6.TheContractorshallsupplytheOwnerwiththemaintenanceequipmentspecifiedinAppendix（;）。第三条业主的职责1.业主应提供工地，并在本合同有效期内同意承包商自由地、不受干扰地出入该工地。2.业主应按时提供附录times;中指定的物件和设备。3.业主将从有关部门获取为工厂建造、设备运转所必需的执照和许可证，包括承包商雇员的工作许可证。4.业主应按第times;条中规定的合同价格向承包商支付工程款项。Article3-Owner’sResponsibilities1.TheOwnershallmakeavailabletheSiteandgranttheContractorfreeanduninterruptedaccesstheretothroughoutthedurationofthisContract.2.TheOwnershallprovidethoseitemsandfacilitiesspecifiedinAppendix（;）atthetimethereinestablished.3.TheOwnerwillobtainfromtherelevantAuthoritiesthoselicensesandpermitsnecessarytoconstructandoperatethePlantontheSiteincludingworkpermitfortheContractor’semployees.4.TheOwnershallpaythecontractorfortheWorksperformedtheContractPricesetoutinArticle（;）。第四条合同价格1.在本合同生效后times;times;天内，业主应向承包商支付金额为合同价格，作为承包商完成该工程并承担本合同规定的所有义务的全部酬劳。2.合同价格不再上调，完成工种的本钱风险应由承包商承担，商定合同价格时应认为承包商已获得全部信息并已把所有可能妨碍本钱的要素可能在内。Article4-ContractPrice1.Within（;）daysaftertheeffectivedateofthisContract，theOwnershallpaytheContractorasfullandcompletecompensationforaccomplishingtheWorksandassumingallobligationsunderthisContracttheContractPriceintheamountof.2.TheContractPriceisnotsubjecttoescalation，andthecostofexecutingtheWorksshallbetheriskoftheContractorwhoshallbedeemedtohaveobtainedallinformationandtakenintoaccountallcircumstanceswhichmayaffectthecostinagreeingtheContractPrice.第五条设计图样1.承包商应依照合同，在附录times;time...
