网约车的法律问题研究摘要随着移动互联网的迅猛发展,在全球范围内行业的结构发生了巨大的变化,在交通领域特别是城市客运运输方面出现了这几年十大新词之一的“网约车”。近几年,网约车发展使得我国城市交通的结构发生了很大的变化,符合了人民生活日益提高寻求个性化的出行方式。越来越多的人喜欢乘坐网约车,热捧它,使得它的成长出现了野蛮式的成长。因为网约车才刚刚出现存在着很多问题,面临了很多争议。通过大量相关文献的阅读和分析本文主要分了三个部分。第一部分主要介绍了本文的研究意义及目的和国内外的研究现状。进一步,讲述了网约车的概述和网约车发展到今天遇到的法律障碍以及私家车进入平台缺乏法律地位,网约车打车软件产生的安全隐患等问题进行了分析介绍,这些问题不久很定会有改善的。第二部分也是本文的重点,主要介绍了网约车涉及的法律问题,一是分析了网约车的合法性;二是介绍了网约车车市场准入的行政许可以及不同国家市场准入的基本情况;三是分析了网约车平台与经营服务者在不同协议模式和具体的交通侵权的责任认定中法律主体和赔偿责任问题以及网约车与乘客之间合同成立的不同方式和网约车平台承担实际承运人责任的等问题。第三部分根据对上述问题的分析提出了对网约车管制的完善建议,一是建立网约车真正的非法地位;二是制定网约车运营规范及服务标准;三是建立同行业联盟关系;四是政企合作监管。关键词:网约车,法律问题,合理监管ABSTRACTWiththerapiddevelopmentofmobileInternet,structurehasundergonetremendouschangesintheglobalscopeoftheindustry,especiallyinthefieldoftrafficofcitypassengertransportappearedinrecentyearsoneofthetenwords"networkaboutcars".Inrecentyears,thedevelopmentofnetworkbushasmadegreatchangesinthestructureofurbantrafficinourcountry.Ithasmettheincreasingdemandofpeople'sdailylifeandsoughtpersonalizedtravelpatterns.Moreandmorepeopleliketousethenettomakeacar,andholdithot,whichmakesthegrowthofitgrowsavagely.Becausethenetcarjustappeared,therearemanyproblems,facingalotofcontroversy.Throughalargenumberofrelatedliteraturereadingandanalysis,thispaperisdividedintothreeparts.Thefirstpartintroducesthesignificanceandpurposeofthisstudyandthecurrentresearchsituationathomeandabroad.Further,describestheoverviewandnetaboutcaraboutcarstolegalobstaclesencounteredtodayandthelackofthelegalstatusofprivatecarsenteringtheplatform,introducesandanalyzestheproblemsaboutcartaxisoftwaregeneratedsecurityrisks,theseproblemswillsoonbeimproved.Thesecondpartisthefocusofthispaper,mainlyintroducesthelegalproblemsaboutthecarinvolved,oneistoanalyzethelegitimacyofnetworkaboutcars;twoistheadministrativelicensingnetworkaboutcarmarketaccessandthebasicsituationofdifferentcountriesinmarketaccess;threeistheanalysisofnetworkserviceplatformandmanagementaboutthecarindifferentprotocolmodeandspecifictraffictortliabilitybetweenthecognizanceoflegalsubjectandliabilityissuesaswellasnetworkaboutcarsandpassengersindifferentwaysandtheestablishmentofthecontractnetaboutcarplatformbeartheresponsibility.Thethirdpartputsforwardthesuggestionsaboutvehiclecontrolnetworkbasedontheanalysisoftheaboveproblems,oneistoestablishanetworkofillegalstatusaboutrealcar;thetwoistodevelopnetworkaboutcarsoperatingstandardsandservicestandards;thethreeistheestablishmentofthesameindustryalliance;fouristhecooperationofgovernmentsupervision.KEYWORDS:Netcarabout,Legalissues,Reasonablesupervisio目录摘要.........................................................................................................................................................2前言........................................................
