浅析我国的少年法庭制度摘要随着我国经济的发展和人民生活水平的逐渐提高以及生活的日益丰富，我国社会不断进行转型，未成年人的价值观念呈现出多元且混乱的状态，加上未成年人心智的不成熟，未成年人的犯罪问题日渐严重，特别是校园欺凌暴力案件，大部分案件都没有得到法律的深究，案件情形多种多样，道德错误与违法犯罪相重，导致犯罪未成年人得不到及时的教育和挽救，也无法对受害未成年人的合法权益进行有效保障。但未成年人是祖国未来生存发展的希望和保障，所以这些问题必须引起我们和社会的广泛关注，其中司法保护是目前最重要的保护手段，而国家司法又要通过少年法庭的司法审判来保障和实现，所以少年法庭是国家的发展之选，少年法庭不仅要通过司法审判来感化、教育、挽救犯罪的未成年人，还要让少年法庭来切实维护受害未成年人的合法权益，为未成年人的生活学习营造一个健康良好的环境。所以有必要从少年法庭制度的理论出发，通过对个别先进外国少年法庭制度的分析和借鉴，针对我国的少年法庭制度现存的问题，提出对本国少年法庭制度完善的发展建议，其中包括扩大受案范围、丰富矫治机制等，以适应当代社会发展的需要。关键词：依法治国；少年法庭；惩戒措施ABriefAnalysisoftheJuvenileCourtSysteminChinaAbstractWiththedevelopmentofeconomy,thegradualimprovementoflivingstandardsofpeopleandtheincreasingabundanceoflifeinChina,thesocietyhasbeenundergoingacontinuoustransformation,resultingthatthevaluesofjuvenilesappearmultidimensionalandchaotic.Besides,juvenilesareoftenimmatureinmind.Insuchcontext,theproblemsofjuveniledelinquencybecomeincreasinglyserious,especiallythebullyingandviolenceonthecampus.Mostofthecaseshavenotbeenbroughttojustice,andthecasesareoftendistinctandoverlapmoralerrorsandcrimes,whichresultthatthejuveniledelinquentscannotbetimelyeducatedandcorrected,andthelegitimaterightsandinterestsofjuvenilevictimscannotbeeffectivelyprotected.Nevertheless,juvenilesarethehopeandguaranteeofthefuturesurvivalanddevelopmentofacountry,sobothusandthesocietyshouldpaywideattentiononthejuveniledelinquencyproblem.Consideringthatthejudicialprotectionisthemostimportantmeansofjuvenileprotectionatpresent,andthejudicialtrialofthejuvenilecourtisthemeanstoguaranteeandrealizejudicialprotection,sothejuvenilecourtisthenecessityforthenationaldevelopment.Thejuvenilecourtshouldnotonlyinfluence,educateandcorrectthejuveniledelinquentsbyjudicialtrial,butalsoeffectivelysafeguardthelegitimaterightsandinterestsofthejuvenilevictims,creatingahealthyandsoundenvironmentforthelifeandstudyofjuveniles.Therefore,basedonthetheoryofjuvenilecourtsystem,andtheanalysisandreferenceofsomeadvancedforeignjuvenilecourtsystem,andcombingwiththeexistingproblemsofthejuvenilecourtsysteminChina,itisputforwardinthispapersomesuggestionsforthedevelopmentofjuvenilecourtsysteminChina,includingexpandingthescopeofcaseacceptanceandtheenrichmentofcorrectionmechanism,soastomeettheneedsofthedevelopmentofthecontemporarysociety.Keywords:Law-basedGovernance;JuvenileCourt;DisciplinaryMeasures.目录................................................................1..........................................1...................................1...................................2......................................3........................................3........................................4......................................6............................6........................6....................................7........................................7.....................................8......8.......................
