英文聘任协议(聘任外国人)ⅠPartyA___________wishestoengagetheserviceofPartyB______________as______________.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.ⅡTheperiodofservicewillbefromthe______dayof______,20__tothe______dayof______,20__ⅢThedutiesofPartyB(seeattachedpages)ⅣPartyB’smonthlysalarywillbe￥_______yuanRMB,__%ofwhichcanbeconvertedintoforeigncurrencymonthly.ⅤPartyA’sObligations1.PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA’worksystemandregulationsconcerningadministrationofforeignexperts.2.PartyAshallconductdirection,supervisionandevaluationofPartyB’swork.3.PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.4.PartyAshallprovideco-workers.5.PartyAshallpayPartyB’ssalaryregularlybythemonth.ⅥPartyB’sobligations1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina’sinternalaffairs.2.PartyBshallobservePartyA’sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA’sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA’sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.4.PartyBshallrespectChina’sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.5.PartyBshallrespecttheChinesepeople’smoralstandardsandcustoms.ⅦRevision,CancellationandTerminationoftheContract1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.3.PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.(2)Accordingtothedoctor’sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave.4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.(2)PartyAhasnotpaidPartyBasscheduled.ⅧBreachPenaltyWheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyofUS$500to2,000(ortheequivalentinRMB).IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA’sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB’sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB’sreturnexpensesandpayabreachpenaltytoPartyB.ⅨTheappendixofthiscontractisaninseparablepartofthecontractandhasequaleffectⅩThiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty90dayspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires.ⅪArbitrationThetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtotheorganizationofarbitrationforforeignexpertsaffairsintheStateAdministrationofForeignExpertsAffairsandaskforafinalarbitration.ThisContractissignedat_____________,induplicate,this_____dayof_______,20__,intheChineseand_______languages,bothtextsbeingequallyauthentic.PartyAPartyB(Signature)(Signature)
