SeveralProposalsoftheStateAdministrationforIndustryandCommerceonBringingtheFunctionsofAdministrationforIndustryandCommerceintoFullPlaytoFurtherProvidingServicefortheDevelopmentofForeign-InvestedEnterprisesAdministrationsforindustryandcommerceandmarketsupervisionadministrationsofallprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernment,municipalitiesseparatelylistedonthestateplanandsub-provincialcities:ForthepurposeofconscientiouslyimplementingtheSomeCommentsonFurtherDoingaGoodJobintheUtilizationofForeignCapitalpromulgatedbytheStateCouncil,bringingthefunctionofadministrationforindustryandcommerceintofullplay,providingbetterserviceforthedevelopmentofforeign-investedenterprises,givingbetterplaytothepositiverolesoftheforeigncapitalinpromotingtechnologicalinnovation,industryupgrading,regionalcoordinateddevelopmentandotheraspects,acceleratingandimprovingthequalityandlevelofforeigncapitalutilizationandgivingimpetustothetransferofeconomicdevelopmentmodesactively,thefollowingcommentsareherebyproposed:I.FurtherEncourageForeignInvestorstoIncreaseInvestment(I)Fullysupportgroupoperationofforeign-investedenterprises.Investmentcompaniesestablishedbyforeigninvestorsareencouragedtoapplyforestablishingenterprisegroups.Thenamesofenterprisegroupsareallowedtohaveabbreviations;theparentcompaniescanusesuchmarkas“group”or“(group)”intheircompanynames;thenamesofsubsidiarycompaniescanbeprecededbythenamesofenterprisesgroupsortheabbreviations;joint-stockcompanies’namescanalsobeprecededbythenamesofenterprisegroupsortheabbreviationswiththeapprovalfromtheenterprisegroups.(II)Fullysupportcapitalincreaseofforeign-investedenterpriseswithcreditors’rights.Activelyresearchadministrativemeasuresforcapitalcontributionwithcredit,andstandardizetheproceduresofcapitalcontribution.Conscientiouslydoagoodjobinthemodificationregistrationofwaysofcapitalcontributionsofforeign-investedenterprises.Upontheregistrationofforeignexchangeandapprovalfromtheapprovalauthorities,greateffortsshouldbemadetosupportinvestorsofforeign-investedenterprisestoincreasetheregisteredcapitalwiththecreditors’rightsoftheenterprises.(III)Activelyencourageforeigninvestorstoestablishpartnershipenterprises.EncourageforeignenterprisesorindividualswithadvancedtechnologiesandmanagementexperiencetoestablishpartnershipenterprisesinChinathroughenhancingguidance,practicingmorecoordinationandimprovingefficiency,anddiversifytypesofforeign-investedenterprisesandbroadenchannelsofforeign-relatedeconomiccooperationandtechnologicalexchanges.(IV)Positivelyrenderhelptoalleviateinvestmentdifficultofforeign-investedenterprises.Forthoseforeign-investedenterpriseswhichdefaultonfurthercapitalcontributionsduetotemporarycapitalshortageaftertheinitialcapitalcontributionandwithoutarecordoflaw-1breaking,aprolongedtimelimittothecapitalcontributionshallbegrantedbytheregistrationauthoritiesupontheapprovalofapplication.II.Promotethestructureoptimizationofforeigncapitalutilizationvigorously(V)Vigorouslysupportaccelerateddevelopmentofforeign-investedserviceenterprises.Whollyforeign-investedenterprisesorforeign-investedenterprisescontrolledbyforeigninvestorsusingthetitlesofenterprisesinforeigncountries(regions)canapplytousesuchmarkas“(China)”intheirnames,iftheyinvestinmodernserviceindustryandhighandnewtechnologyindustrywithregisteredcapitalofRMB30,000...
