I对《劳动合同法》强制性规定合理性的思考摘要《劳动合同法》作为我国社会法法律部门的重要组成部分,不同于民法法律部门中《合同法》的关键,在于其中的许多强制性规定。这些强制性规定是否合理,极具分析之必要。从现实存在的困难来看,这些规定保护的仅仅是少部分人的利益,而且这部分人未必是真正需要帮助的人;从未来面临的挑战来看,因这些规定缺乏弹性,恐难适应未来激变的社会,反会变成社会的不稳定因素。无论从现实存在困难还是从未来面临的挑战来看,《劳动合同法》中许多强制性规定的合理性存在疑问。关键词:劳动合同;强制性规定;合理性IIConsideration on the rationality of labor contract law’s compulsory regulations AbstractLabor contract law, as an important component of social law in China, is different from contract law in the civil law department. The key difference between the two laws lies in many compulsory regulations. This paper analyzes the rationality of these compulsory regulations from two perspectives. From the perspective of the practical problems, only a small number of people will benefit from these compulsory regulations, and they may not be the people who really need help.From the perspective of future challenges,because of the lack of flexibility, these compulsory regulations can hardly adapt to a rapidly changing society,and even become a social unstable factor. No matter what point of view from these two angles, there are doubts about the rationality of many compulsory regulations in labor contract law.
