对二手房买卖过程中“跳单”问题的研究 摘 要改革开放以来,房地产行业的得以迅猛发展,二手房市场也不断走向成熟,并在房地产交易市场中扮演着重要的媒介作用,尤其是在二手房交易市场,通过房地产经纪公司作为交易桥梁,促成二手房交易,已经成为一种普遍方式。但是随着房地产业的发展,在实践当中出现了经纪公司的居间服务质量参差不齐,甚至出现欺诈、胡乱收费现象、市场秩序混乱,房地产经纪公司与委托人之间存在的纠纷连连不断,其中在二手房交易过程中“跳单”问题的纠纷尤为突出。本文将从房地产经纪公司的角度出发,客观、公正的对二手房买卖中存在的“跳单”现象进行分析研究,主要以“陶德华”案例、“徐稀成”案例为基础进行分析研究,以求从案列分析中,探寻二手房交易过程中导致“跳单”的原因,通过对引起“跳单”问题的原因分析,探求减少二手房买卖过程中“跳单”问题的方法以及措施,以便促进我国二手房买卖市场健康有序地发展。并希望能够为我国房地产经纪行业做出应有的贡献。 关键词:二手房;二手房市场;居间合同;跳单 PAGE \* MERGEFORMATIIIAbstracSince China's reform and opening up, to the rapid development of real estate industry, the secondary market also become more mature, and in the real estate market plays an important role in medium, especially in the secondary housing market, through real estate brokerage company as a trade bridge, facilitate the second-hand housing transactions, has become a common way.
