1目 录我国建筑物区分所有权之共有权探究 [摘要] 20 世纪住房商品化改革之后，我国的城镇化加速进行，人口快速向城镇集中，人地关系紧张导致高层住宅成为首选。这就产生了建筑物区分所有权之共有权、共有权的定性、共有部分的范围以及法律对共有权的保护等等诸多问题因此，本文通过分析美国、法国以及德国等国家有关建筑物区分所有权之共有权的立法，对我国法律中有关其未对业主大会作出明确规制以及关于车位、车库的规定欠妥等问题进行探讨并提出完善建议。 [关键词] 建筑物区分所有权； 共有权；共有部分；完善建议 [Abstract]China's urbanization accelerated after the commercialization of housing in the 20th century,the population is rapidly concentrated in towns and cities, high-rise housing has become the first choice because of the tension between people and land.which gives rise to the question of the co-ownership part of condominium, the qualitative of the common rights, the scope of the co-ownership and the protection of the common rights.Therefore,this article makes a comparison and analysis of the common ownership of condominium ownership in the United States, France, Germany and other countries,and Did not make a clear regulation to the owners and scope of common parts and Parking spaces and garage regulations are not proper.
