交通事故车辆贬值损失赔偿问题研究论文

本科论文摘 要随着道路和交通事业的发展，近年来，机动车辆交通事故频繁发生，产生了车辆减值赔偿这一新的法律问题。现行的法律、司法解释等未明确将车辆贬值损失列入赔偿项目，司法实务中各地鉴定机构资质不一，并无统一的计算方法，导致各地的法院裁判分歧较大，裁判理由缺乏说理依据，屡遭公众质疑。如果不对其赔偿制度进行法律规范，公民合法的财产损失无处救济，法院同案不同判的审理结果也会弱化司法权威。因此，应尽快建立车辆贬值损失赔偿的法律制度，让公民合法权益有坚实的法律保障，社会公平正义的法治理念能够深入人心。本文想要分析车辆价值贬损的现实困难有哪些，并针对性的提出车辆价值贬损的机制完善建议，在此过程中明确机动车价值贬损的可赔偿性，从而为车辆贬值损失提供更为坚定的理论支撑，减少实际操作中困难。关键字：交通事故；车辆贬值；损失赔偿 AbstractWith the development of road and traffic, in recent years it has brought about a new legal problem -- the impairment loss compensation caused by traffic accidents. In the current road traffic accident compensation cases, more and more victims not only require the responsible party to compensate for the repair cost of the vehicle, but also demand compensation for the depreciation loss of the vehicle.Which leads to the wide differences in the court judgments, and the lack of reasoning basis for the judgment, which is often questioned by the public.
