小议情势变动规则的应用 摘要：情势变更原则是合同履行中的重要原则，许多国家的合同法都有相应的规定，我国现行法律中并未明确规定这一原则。文章认为情势变更原则在我国的确立有其必要性，而其适用问题是理论和实践结合最密切的部分。文章分五个部分对情势变更原则的适用问题进行阐述。第一部分简单介绍了情势变更原则的内涵，第二部分分析了适用该原则的条件，第三部分是对适用情势变更原则的法律效果的论述，第四部分是对该原则适用中的若干问题的解析，第五部分为我国确立情势变更原则的意义、面临的障碍及其排除。 关键词：情势变更；适用条件；效力；不可抗力 ApplicationofCircumstanceChangePrinciple Abstract：TheCircumstanceChangePrincipleisaimportantprincipleofcontractimplementmedium,allhavethehomologousprovisioninlawrulingsofmanycountrys.Currentlawofourcountryindidnotrulethisprincipledefinitely.ThisarticlethinksthattheCircumstanceChangePrinciplereallysignsitintheourcountrynecessity,andtheapplicationoftheprincipleisthepartonwhichitstheoryandpracticearemostcloselyintegrated.Thearticleisdividedintofiveparts,elaboratingtheproblemontheApplicationofCircumstanceChangePrinciple.Thefirstpartintroducesthecontentofthisprincipleinbrief.Thesecondpartanalyzestheconditionofapplingthatprinciple.ThethirdpartisatreatiseofthelawresulttoapplytheCircumstanceChangePrinciple.Four-partcentisaresolutionaboutsomeproblemsesontheapplicationoftheprinciple.Thefifthpartdiscussesthemeaningofestablishingtheprincipleinourcountryandsomedifficultieswehavetoovercome.
