论文名称:对用人单位解除劳动合同法律责任的思考 摘要《劳动合同法》对完善劳动合同制度,明确劳动合同双方当事人的权利和义务,对保护劳动者的合法权益,构建和发展和谐稳定的劳动关系,起了较大的推动作用。违法解除劳动合同,不同于依法解除劳动合同;违法解除劳动合同的赔偿,不同于依法解除劳动合同的经济补偿。本文首先对相关概念进行界定,在此基础上分析用人单位违法解除劳动合同的形式和原因,同时指出《劳动合同法》的进步和不足之处,对用人单位违法解除劳动合同应当如何承担法律责任及其法律适用与完善问题进行初步探讨,以期使合法权益受到侵害的处于弱势地位的劳动者得到妥善而适当的救济。关键词:劳动合同、劳动合同的解除、违法解除劳动合同ABSTRACTMake rights and duties of labor contract both sides interested party clear , structure and develop harmoniously stable physical labor to protecting legal rights and interests of the workers, to have concerned, up bigger push effect "contract law working" to perfect labor contract system.
