论我国商业秘密保护法律制度的完善论我国商业秘密保护法律制度的完善摘要：商业秘密的保护是全球性的法律问题。我国侵犯商业秘密的违法行为也日趋增多。由于我国步入市场经济较之西方国家晚了很多年，因此关于商业秘密保护的立法很不完善。如何有效保护商业秘密和遏制侵犯商业秘密，便成为我国经济法学界关注的焦点。本文结合我国现有的法律规定，并根据西方国家的先进立法理念对我国的商业秘密立法问题进行严肃而又积极的探讨，将有助于完善我国商业秘密保护法律制度。关键词：商业秘密保护；法律缺陷；完善建议The Discussion of Perfecting Law on Protection to Trade SecretsAbstract ： The trade secret protection is a global legal issue, and the illegal activities about infringing the trade secret in our country are becoming more and more. Because the time our country steps into the market economy is later than the western country, many laws about trade secret protection is not completed. So, how to protect the trade secret and inhibit the illegal activities about infringing trade secret turn into focus in the study of economic constitution. This article, which is according to the advanced ideas in western country and combining the related law in our country, discusses the problem about the law of trade secret carefully and positively.
