施工合同工程价款纠纷研究 针对目前全国范围内工程款拖欠越演越烈的局面，站在弱势群体建筑企业（承包人）的角度，第一次全方位提出了解决工程价款纠纷问题的具体策略和解决办法。首先对施工合同的有关概念进行了阐述和分析，并对合同价款、工程造价和工程价款等概念之间的关系进行了界定，明确了工程价款这一基本概念的内涵和外延。其次，通过对工程价款纠纷类型的梳理和分析，站在不同的角度，归纳出了工程价款纠纷的常见类型。再次，对造成工程价款纠纷的原因进行了细致的分析，总结出了目前造成工程价款纠纷的五类原因。其中着重阐述了施工合同存在缺陷和漏洞造成的建设工程价款纠纷。然后，针对十二种具体的工程价款纠纷，站在建筑企业（承包人）的角度，阐述了解决工程价款纠纷的具体策略和解决办法，打破了工程价款认定难的“瓶颈”，为建筑企业（承包人）追讨工程价款维护合法权益提出了切实可行的措施。最后，提出了从根本上遏止减少施工合同工程价款纠纷三个方面的措施：一是在《建筑法》中增加工程价款的结算的内容，二是律师全过程介入建设工程的发承包活动，三是培养全民良好的法律意识。 关键词： 施工合同 工程价款 拖欠 Abstract Facing the problem of the construction cost default in the national range, standing on the weak party i.e. the contractor’s position, the author bring forward the material strategy and means to settle it for the first time.Firstly, this paper analyzes the construction contract. Through construing the relationship between the contract prices the construction cost and the price of construction, this paper define the concept of construction cost. Secondly, by investigating the different types of dissension about construction cost, this paper concludes the common style of dissension about construction. Thirdly, this paper takes a deep research on the causations resulting in dissension about construction cost.
