AbstractAlong with the wide-ranging intervention of mass-medie in life of modern society,the supervision by public opinion of news plays an important role in the life of society and the construction of democratic legal system.But in recent years, because of the civil lawsuit caused news infringement has presented a growing trend. In such cases, is undoubtedly the news torts laws system is not perfected. Based on the news tort system of the legislation value analysis, further pointed out that the system improved at my country the necessity and importance. Because of news tort laws system in China's existing laws and regulations did not clearly improved ， each judge has not a unified standard in judicial practice. The news tort system, through drawing on the experience exist in other countries on China's building a system to suspend the news tort system prosecution of a number of recommendations put forward specific.Key words：news torts；the encroacher principle；constitutions；the burden of proof；defenses浅论我国新闻侵权制度立法所谓新闻侵权又称新闻报道侵权，一般是指报社、杂志社、电视台、等新闻传播工具在报道新闻时，对公民、法人和其他组织的名誉权、荣誉权、名称权等其他合法权益造成的不法侵害。新闻侵权的客体主要是法人的名称权和公民的人格权，其中人格权包括姓名权、隐私权、荣誉权、名誉权、肖像权等。新闻媒体不仅作为党和政府的舆论阵地，又是人民群众的监督工具，在这个背景下，媒体侵权无疑会使公民对新闻媒体失去信心。因此，本文立足今日，展望未来，力图把握住新闻侵权的本质，提出一些有关完善立法的建议和设想，虽有可能仍嫌肤浅和不够成熟，但希望以此来对我国新闻侵权制度的完善和进展尽微薄之力。一、建立我国新闻侵权制度的重要性近几年来，随着现代科学技术的进展，电视、网络、报纸、杂志、广播电台等传播媒介也随之切入人们的日常生活，成为生活中不容忽视的一部分，成为人们获得信息的主要途径，在很大程度上影响人们的价值推断与取向。（一）社会的进...
