Since last century, the question of environment pollution is increasing, at the same time, the case about environment right infringement is increasing, the environment right infringement has become one of new abuses of authority. How to qualitative the environment right infringement ,how to eliminate the harm and make the victim can obtain the effective relief is become the important topic which various countries' judicature and the legislation is doing. This article through the summary of domestic' environment right infringement at present situation, discover the flaw in Chinese environment right infringement legislation at presently, emphatically elaborates the relief system contents, for example, the principia of liability about environment right infringement ,the document of constitution, exemptions and so on.At last ,bring up the propose about flawless the law of Chinese’ environment right infringement.Key words: the infringementlegislation about environment right；the principia of liability ； the causal relationship ； the exemptions ；punitive damages浅论我国环境侵权立法完善自上世纪以来，环境污染问题日益突出，与此同时环境侵权案件日益增多，环境侵权成为了新型侵权行为之一。如何定性环境侵权，如何消除危害，使受害人得到有效救济是各国司法和立法都在努力探究的重要课题。本文通过简述国内环境侵权现状，发现现中国环境侵权立法缺陷，着重论述环境侵权的归责原则、构成要件、免责事由等救济制度内容，提出完善我国环境侵权立法的建议。一、我国环境侵权立法完善的必要性（一）社会现实推动我国环境侵权立法完善随着中国经济的快速进展，发达国家需时上百年、分阶段出现的环境问题在中国集中出现，环境与进展的矛盾日益突出，导致环境污染与生态破坏日趋严重，由此产生的权益损害也随之增多。除了上述宏观原因外，环境法制不健全、绿色 GDP 缺位，以及执法力度薄弱是导致环境侵权增多的主要原因，如个别政府为了政绩考核和经济利益的驱动，放任污染企业继续污染生产；个别...
