Abstract The system of punitive compensation is a system of liability to pay compensation for damage from Anglo—American law system.At present,China has been establishing the system in the legislation.However,there are geave defects in the relevant legislation.So the function that the system contain delicts with punitive compensation cannot be fulfilled.This paper will begin by analyzing the value of the system of punitive compensation,combine the legislate present situation,point out the defect,use the relevant legislation advanced experience of other countries and TaiWan Prefecture for reference,on the basis of demonstarting that improve the system of punitive compensation with full feasibility,advance the countermeasure that how to improve. Key word ： legal liability ； punitive compensation ； the system of punitive compensation；legislative perfect 试论我国惩处性赔偿制度的完善从“三聚氰胺牛奶、瘦肉精、苏丹红”等触目惊心的食品侵权，到“蓝藻污染、镉污染、铅污染”等环境侵权，再到“银广夏、高淳陶瓷、广发证券”等证券侵权，我国的重大侵权事件层出不穷。同时，我们发现恶意欠薪、恶意欠款、消费欺诈等故意侵害合同对方当事人合法权益的事件也比比皆是。严峻的现状一次又一次残酷地摆在国人面前，如何才能遏制这一严峻形势的进展态势成为了人们广泛热议的问题。虽然我国早已确立了刑事制裁、行政制裁和民事制裁，尤其是民事损害赔偿制度，但是一次甚过一次的残酷现状说明我们必须要对现行制度进行反思。笔者以为，刑事制裁门槛过高，行政制裁阻吓过小，而作为民间重要监督力量的民事赔偿制度却因以补偿性赔偿为主而起不到足够的惩处与遏制效果，即便惩处性赔偿制度早已引入，但因其适用范围过窄、赔偿数额标准设置不科学等缺陷而无法唤起受害人维权监督的动力，从而变相地放纵了侵权人的不法行为。因此，受害人在损害赔偿博弈中的缺席正是症结所在。对此，本文拟借鉴国外和我国台湾地区关于惩处性赔偿制度成功的立法经验，论证完善该项制度的可行性，并就如何完善我国惩处性赔偿制度提出对策，以期通过完善的制度唤起受害人维权...
