AbstractThe private property right is a fundamental right of the citizen. Along with our country socialist market economy development,individual has more and more the property.the private property legal protection has become important issue which in our country government by law construction must study and solve. The current constitution of our country had been gone through several modification ， especially in the fouth bill for amendment，the protection of the private property makes greater progress，but still had the flaw and could not meet the need of the social development. In this paper, our need for constitutional protection of private property as a starting point, analysis of the constitutional protection of private property, the main problems, and learn from foreign experience in the successful protection of private property, private property in China put forward a sound constitutional protection. Key words: Private Property Right ； Constitutional Protection ； Judicial Review of Constitution 试论我国私有财产的宪法保护个人自治与尊严是当代文明的核心价值，而私有财产是实现个人自治与保持个人尊严的必要条件。财产、自由和生命是人类生存的三个最基本要素，而私有财产权的确立是所有公民权中最神圣的权利。私有财产权使个人拥有自己控制并不受他人干预的领域和范围成为可能，从而使个人拥有自己独立的精神世界。宪法作为国家的根本法和社会共同体的最高法律规范体系，通常把公民私有财产的保护作为整个社会追求的基础和出发点，公民私有财产权离不开宪法的保护，宪法在保护公民私有财产权问题上起到独特且不可替代的作用。一、我国私有财产宪法保护的必要性私有财产权是公民的一项基本权利。随着市场经济的进展和人民财产观念的增强 ，私人财产权保障的呼声日益高涨。私有财产的保护已成为我国法治建设中亟待讨论和解决的一个重大课题。（一）私有财产的宪法保护是保护公民基本权利的需要我国是一个社会主义国家，对公民生命权、自由权等权利的保障我国宪法早就有了规定，我国一直...
