AbstractThe private property right is a fundamental right of the citizen. Along with our country socialist market economy development,individual has more and more the property.the private property legal protection has become important issue which in our country government by law construction must study and solve. The current constitution of our country had been gone through several modification ， especially in the fouth bill for amendment，the protection of the private property makes greater progress，but still had the flaw and could not meet the need of the social development. In this paper, our need for constitutional protection of private property as a starting point, analysis of the constitutional protection of private property, the main problems, and learn from foreign experience in the successful protection of private property, private property in China put forward a sound constitutional protection.
