中 文 摘 要绑 架 罪 是 我 国1997 年 刑 法 新 增 加 的 一 个 罪 名，该 罪 的 作 案 手 段 残 酷 ， 行 为 方 式 不 断 翻 新 ，严重 侵 犯 了 公 民 的 人 身 权 利 和 财 产 权 利 ， 给 社 会秩 序 的 稳 定 也 带 来 了 负 面 影 响 。 现 行 刑 法 对 绑架 罪 的 罪 状 描 述 比 较 简 单 ， 造 成 在 司 法 实 践 中对 本 罪 的 客 观 方 面 、 犯 罪 主 体 、量 刑 尺 度 的 认定 存 在 很 大 争 议 。本 文 通 过 对 外 国 绑 架 罪 立 法的 对 比 与 借 鉴 ， 结 合 我 国 基 本 国 情 ， 对 完 善 我国 绑 架 罪 提 出 一 些 建 议 。 完 善 我 国 绑 架 罪 ，有利 于 切 实 打 击 绑 架 犯 罪 ， 维 护 社 会 秩 序 的 安 定 。关 键 词 ： 绑 架 罪 ； 单 一 行 为 ； 绝 对 死 刑 ； 加重 情 节AbstractThe crime of kidnapping is a new-added charge in our 1997 criminal law. The crime of kidnapping methods ruthless and the manners are continuous to renovate. It no matter violations of personal and property rights, but also disturbs social peace. The existing criminal law describes the kidnapping counts simply to cause judicature practice has many dispute on objective element, subject of crime, legal punishment. To combine fundamental realities of China and benefit from foreign theory, I’ll propose some perfection of legislation.
