本科毕业设计-试论我国行政程序的立法完善

AbstractThe scientific and legal administrative procedures can control the administrative acts,supervise subject of administration duties according to law,protect the interests of the subject of administration and private party and achieve fairness and efficiency.Single laws of administrative are lack of rights protection of private party which make the private party difficult to protect rights.This article analyzes the difficulties of legislative improvement of administrative procedure,points out the necessity and importance of legislative improvement of administrative procedure in our country.There are so many single laws of administrative in our country ， but there is no uniform code of administrative procedure,so there is no uniform standard of the implementation of the legislation around the practices.The author refers to the experience of the legislative improvement of administrative procedure in foreign countries,makes suggestions of the legislative improvement of administrative procedure for our country.Key words:Administrative procedure ； Codification ； Administration according to law试论我国行政程序的立法完善行政程序是行政主体实施行政行为时所应遵循的方式、步骤、时限和顺序。行政程序作为规定行政权、体现法治形式合理性的行为过程，是实现行政法治的重要前提。可是，我国对行政程序方面的法律法律规范尚不完善，使得类似“钓鱼执法”这种行政程序违法的现象时有发生。对行政违法的救济方式又只能靠《行政复议法》、《行政诉讼法》、《国家赔偿法》这些法律提供的事后救济和保障，这明显不利于保护行政相对人的合法权益。所以，只有通过行政程序的立法完善，才能使行政相对人的权益得到最直接的保障，法律规范行政主体依法行政。一、我国行政程序立法完善的重要意义行政程序作为法律规范行政权、体现法治形式合理性的行为过程，是实现行政法治的重要前提，而行政程序发达与否，是衡量一国行政法治程度的重要标志。（一）有利于行政主体依法行政依法行政的基本含意是指政...
