AbstractThe theory of anticipated possibility,originated from Gemany,has gotten approbation in many country’s criminal law science.However,the concept has no counterpart in china’s criminal law.In recent years, China's criminal law scholars have begun to tap into this theory, but different opinions. This paper briefly describes the historical evolution and anticipated possibility of related concepts, from anticipated possibility of the value criterion, and contacts with the criminal law concept of discussion on this theory, the article states that china's anticipated possibility of the introduction of the need to answer many of china's criminal law theory difficult problems, and will improve our criminal legislation.Key words: anticipated possibility； refernce；criterion试论期待可能性 “没有责任就没有刑罚”是近代以来刑法的一项根本原则。责任是刑罚的前提和基础。为了能够说明行为人存在责任，除了行为人具有责任能力、故意或过失以外，还需要行为人存在实施适法行为的可能性，“法律不强人所难”,即具有期待可能性。期待可能性是指根据具体情况，有可能期待行为人不实施违法行为而实施其它适法行为。期待可能性理论认为，假如不能期待行为人实施其它适法行为，就不能对行为人的行为进行非难，因而就不存在刑法上的责任。一、期待可能性理论的价值分析作为一种由判例进展而成的刑法理论，期待可能性理论能够成为主流理论并历经百年而不衰，显示出它所具有的强大生命力，也充分说明它的价值取向和基本精神与人类社会的现实具有某种契合性。（一）期待可能性的人性基础价值人是刑法调整和法律规范的对象。刑法欲实现其应有的功能和价值，必须要“以人为本”,必须给予人这一特别主体必要的关注。人是社会的人，但更是作为自然存在的人，后者决定了人都有脆弱和自私的一面。因此，刑法理论必须体现终极的人文关怀，人道主义是刑法的基本原则，刑法的人道性要求刑法的制定与适用应与人的本性相符。恰好，期待可能性体现了对人性的关怀。因为当就一般人而言处于无法可想的境地，沉重的心理压力之下，趋利避害、自我保护的本能，人性可能会驱使行为人实施不可想象、...
