AbstractOur country's political law culture, always has loftyly even deifies the country, the government, neglects and even disparages individual the tradition, this is the socialist democracy development big barrier.When the individual cared about and strives for realizes own right and the benefit fully, can constitute the impetus democratic politics to form with the development direct power, when the expansion socialist democracy, all requests the society to continue in the existing foundation to develop the right gradually, limit authority.Therefore, clears off between the right and the authority relations, has the profound significance.Key Words：rights protection；power limiting；State power；social citizens'right试论权利与权力的关系权利与权力的关系是法理学中的一对基本范畴，也是国家与社会，国家机关与社会公民，行政权力与公民权利的反应。深刻认识权利与权力的关系，理清权利与权力之间的对立与联系，对认识我国民主法治进程，建立社会主义法治社会有深刻的意义。一、正确处理权利与权力关系的意义（一）有利于社会公民的权利保护权利作为一种社会现象和一种意识或思想自古以来就有，但西方社会的古代和中世纪，权利的观念是以正义为基础的，没有明确的专指权利的词汇。“直至中世纪临近结束之时，在任何古代或中世纪的语言里，都没有可以用我们的词‘权利’来准确翻译的词语。”在现代，“权利”一般认为包含于英文中的“right”一词，它包蕴公平、正义、真相、正当的、合法的、合适的等等之意，对于其政治意义上概念的分析，有学者在分析历史上出现的权利定义之后给出了一个非常宽泛的定义：权利是道德、法律、习俗所认定的政治的利益、主张、资格、力量或自由。权利是为社会或法律所承认和支持的自主行为和控制人行为的能力，表现为权利人可以为或不为一定行为或者要求他人作为与不作为，其目的是保障一定的物质利益或精神利益。1 权利是与生俱有的、多种多样的。权利就是自己所具有的为或不为一定行为或要求他人作出或抑制某种行为以满足自己某种利用的能动手段。法律上的权利具有以下特征：第一，权利与义务是相对称的。权利与义务是一对范畴，有权利必有义务，...
