与改革开放同行的民法学——中国民法学 30 年的回顾与展望 关键词: 民法学/民法典体系/人格权法/ 物权法/合同法/侵权法内容提要: 改革开放 30 年中, 中国 民法学经历了从荒芜到繁荣的过程, 也经历了从学说继受到学说创新、 进展 的过程。在这期间, 民法学的讨论不仅为我国民事立法提供了重要的理论支持, 建立了基本完善的民法学理论体系, 进行了广泛而深化的司法实践讨论探究, 更为中国未来民法典体系讨论做出了巨大的理论与立法贡献, 初步形成了有中国特色的物权法、合同法理论体系。在检视 30 年民法学理论的辉煌成就的同时, 依旧需要在增强中国民法学讨论的本土性、提升民法学讨论的国际性、注重讨论方法的多样性等方面尽心竭力, 以形成结构 科学 、思想先进的民法学体系。Abstract: In the past three decades s ince China’s reform and opening2up policy, Chinese C ivil L aw has deve lopedf rom nothing to p rospe rity, f rom impass ing and inheriting the exis ting know ledge to innova ting and develop ing newknow ledge. D uring this pe riod, the resea rch on c ivil law has not only p rovided important theore tica l support for the civillegis lation of China and established a sound theore tica l system of c ivil law, but also engaged in extens ive and in2dep thexp lora tion of judicia l p ractice, thus m aking grea t theore tica l and legis la tive contribution to the future s tudy of the civilcode sys tem. In this p rocess, a theoretical system of p roperty law and contrac t law w ith Chinese cha rac te ris tics has basica lly taken shape. In view of the 30 yea rs of c ivil law achievem ents, China s till needs to s trengthen the s tudy of localc ivil law, enhance the interna tiona liza tion of civil law resea rch, and pay attention to the diversity of resea rch m ethods inorder to es tablish a c ivil law sys tem w ith sc ientif ic structure and advanced thinking.Keywords: civi...
