CONSTRUCTION MANAGEMENT AGREEMENTThis Agreement, made this day of in the year , by and between Corporation with its primary office located at (hereinafter referred to as the “Client”), and corporation with its primary office located at (hereinafter called the “Construction Manager”).WITNESSETHThe Client and the Construction Manager agree as set forth below.The Construction Manager shall provide services in connection with the Tender, Design and Construction of the (hereinafter referred to as the “Project”) and as further defined in Appendix 1, Project Description as per the plans and specifications prepared by Office for Metropolitan Architecture hereinafter called the “Consultant”). All in accordance with the Terms and Conditions as stated herein.The Construction Manager accepts the relationship of trust and confidence established between it and the Client by this Agreement. It covenants with the Client to furnish its best skill and judgment and to cooperate with the Architect and other Consultants in furthering the interest of the Client. It agrees to furnish efficient business administration and to use its best efforts at all times in an expeditious and economical manner consistent with the interests of the Client and the Construction Manager.ARTICLE 1CONSTRUCTION MANAGER’S SERVICESThe Construction Manager’s services will be performed following receipt of the Client’s written Notice to Proceed for both the Tender, Preconstruction and Construction phases.
