论领土主权纷争和平解决的主要困境——以钓鱼岛为个案摘要 领土是一个国家赖以存在的物质基础，任何一个国家对于领土主权的态度都是坚定的。领土纷争是主权国家在处理与领国关系中，难免要涉及的问题。因此对于领土主权纷争的研究有助于国家间和平解决争端。中国是世界上陆地边界最长、邻国最多、边界情况最复杂的国家之一，与日本、印度、越南、菲律宾等多个国家存在领土主权争议。中日两国之钓鱼岛争端由来已久，且愈演愈烈，中日两国在钓鱼岛问题的解决上都面临种种原则性困境。这些困境主要有主权的不可分割性、国家利益的冲突性、国际公约的争议性以及民族主义的矛盾性等。从这些困境出发，可以看到钓鱼岛领土主权纷争和平解决需要从经济、外交、文化等多个方面采取强有力的应对措施。关键词 领土主权；钓鱼岛；国家利益；民族主义On the Main Plight of the Peace Settlement of the Disputes over Territorial Sovereign ——The Event of Diaoyu Islands as the Case Abstract Territory is the material basis a country lying on, any country insists firm attitude towards its territorial sovereignty. Territorial dispute is an inevitable issue of a sovereign state in dealing with relationships with neighboring countries, so studies on territorial integrity and sovereignty disputes contribute to the peaceful settlement of disputes between countries. China is one of the countries which have the longest land border, the most neighbors and the most complex boundary condition. It has territorial sovereignty disputes with Japan, India, Vietnam, Philippines and some other countries. The dispute between China and Japan over the Diaoyu Islands has lasted a long time and get even more intensified, they are both faced with plight of principle on the solution of the Diaoyu Islands.
