论网络环境下著作权合理使用制度分析研究 行政管理专业

论网络环境下著作权合理使用制度 [摘 要] 传统的著作权合理使用制度在互联网的飞快发展之下正在遭受严重的冲击，出现了很多以前没有出现的新问题。例如权利的扩张进而导致的利益失衡、立法模式的不足日益显现、技术措施对合理使用制度的压制、网络远程教育等新出现的使用方式的冲击等等。新的问题既关系到我国日后著作权合理使用制度的顺利发展，也涉及到社会大众和著作权人的合法权益。因此，需要结合我国国情，融合其他各国的立法经验，用以完善我国在网络环境下的著作权合理使用制度的立法模式、深入贯彻利益平衡的原则、缓和合理使用与技术保护的矛盾、完善远程教育等新型使用方式下的合理使用制度的适用，以构建更合理的网络环境下的著作权合理使用制度。[关键词] 著作权；网络环境；合理使用；利益平衡[Abstract] The traditional fair use system of copyright is suffering from a serious of impacts because of the development of internet,and a large number of new problems that didn’t come up before have appeared.For example,the the imbalances of rights caused by the power expansion,the weaknesses of legislative mode have appeared day by day,the technical protection measures are suppressing the fair use system,the impact of the new network distance education,and so on.These new problems not only related to the development of the fair use system in China,but also related to legitimate rights of the public and the copyright owner.Therefore,we need to combine China's national conditions with some European and American countries’ legislation Experiences,to improve the legislative mode of fair use system in the network environment,to thoroughly implement the principle of interests balancing, to ease the contradiction between technical protection measures and the fair use system, to improve the network distance education and other new methods of fair use,and finally,to build a more complete and reasonable fair use system of copyright under the internet...
