专利法施行细那么(英文版)篇一：专利法施行细那么(2010英文版)IMPLEMENTINGREGULATIONSOFTHEPATENTLAWOFTHEPEOPLESREPUBLICOFCHINA(PromulgatedbyDecreeNo.306oftheStateCouncilofthePeoplesRepublicofChinaonJune15,2001,amendedthefirsttimeonDecember28,2002accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeoplesRepublicofChina,andamendedthesecondtimeonJanuary9,2010accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeoplesRepublicofChina)TranslatedbytheStateIntellectualPropertyofficeofthePeoplesRepublicofChina.Incaseofdiscrepancy,theoriginalversioninChineseshallprevail.ChapterIGeneralProvisionsRule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeoplesRepublicofChina(hereinafterreferredtoasthePatentLaw).Rule2.AnyformalitiesprescribedbythePatentLawandtheseImplementingRegulationsshallbecompliedwithinawrittenformorinanyotherformprescribedbythepatentadministrationdepartmentundertheStateCouncil.Rule3.AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;thestandardscientificandtechnicaltermsshallbeusedifthereisaprescribedonesetforthbytheState;wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated.WhereanycertificateorcertifyingdocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsisinaforeignlanguage,thepatentadministrationdepartmentundertheStateCouncilmay,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;wherethetranslationisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmitted.Rule4.WhereanydocumentissentbymailtothepatentadministrationdepartmentundertheStateCouncil,thedateofmailingindicatedbythepostmarkontheenvelopeshallbedeemedtobethedateoffiling;wherethedateofmailingindicatedbythepostmarkontheenvelopeisillegible,thedateonwhichthepatentadministrationdepartmentundertheStateCouncilreceivesthedocumentshallbethedateoffiling,exceptwherethedateofmailingisprovedbythepartyconcerned.AnydocumentofthepatentadministrationdepartmentundertheStateCouncilmaybeservedbymail,bypersonaldeliveryorbyotherforms.Whereanypartyconcernedappointsapatentagency,thedocumentshallbesenttothepatentagency;wherenopatentagencyisappointed,thedocumentshallbesenttothecontactingpersonnamedintherequest.WhereanydocumentissentbymailbythepatentadministrationdepartmentundertheStateCouncil,the16thdayfromthedateofmailingshallbepresumedtobethedateonwhichthepartyconcernedreceivesthedocument.WhereanydocumentisdeliveredpersonallyinaccordancewiththeprovisionsofthepatentadministrationdepartmentundertheStateCouncil,thedateofdeliveryisthedateonwhichthepartyconcernedreceivesthedocument.Wheretheaddressofanydocumentisnotclearanditcannotbesentbymail,thedocumentmaybeservedbymakinganannouncement.Attheexpirationofonemonthfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.Rule5.ThefirstdayofanytimelimitprescribedinthePatentLawandtheseImplementingRegulationsshallnotbecountedinthetimelimit.Wherethetimelimitiscountedbyyearorbymonth,itshallexpireonthecorrespondingdayofthelastmonth;ifthereisnocorrespondingdayinthatm...
