国际土木工程建筑承包合同（中英文对照）（4）ifanytestisorderedbytheengineerwhichiseither.36.4凡是工程师命令所作的检验，而（a）not、intendedbyorprovidedfor，or合同没有默示或规定，或（b）（inthecasesabovementioned）isnotsoparticularized，or（在上述情况中）没有如此详细规定，或（c）thoughsointendedorprovidedforisorderedbytheengineertobecarriedoutbyanindependentpersonatanyplaceotherthanthesiteortheplaceofmanufactureorfabricationofthematerialstested，虽有默示或规定，但却是由工程师命令独立个人在工地之外，或在该检验物资的制造或加工地之外的任何地点进行的，thenthecostofsuchtestshallbebornebythecontractor，ifthetestshowstheworkmanshipormaterialsnottobeinaccordancewiththeprovisionsofthecontractortheengineer'sinstructions，butotherwisebytheemployer.如检验结果表明工艺或材料不符合合同规定或工程师指令，检验费由承包人承担，否则由业主支付。37.theengineerandanypersonauthorizedbyhimshallatalltimeshaveaccesstotheworksandtoallworkshopsandplaceswhereworkisbeingpreparedorfromwherematerials，manufacturedarticlesormachineryarebeingobtainedfortheworksandthecontractorshallaffordeveryfacilityforandeveryassistanceinorinobtainingtherighttosuchaccess.37.工程师和他授权的任何人随时有权到工程现场，到任何工程准备地或工程所需材料、制品或机械获得地，承包人应为其行使或获得此种到场权利提供一切便利和帮助。38.（1）noworkshallbecovereduporputoutofviewwithouttheapprovaloftheengineerortheengineer'srepresentativeandthecon第1页共2页tractorshallaffordfullopportunityfortheengineerortheengineer'srepresentativetoexamineandmeasureanyworkwhichisabouttobecovereduporputoutofviewandtoexaminefoundationsbeforepermanentworkisplacedthereon.thecontractorshallgiveduenoticetotheengineer'srepresentativewheneveranysuchworkorfoundationsisorarereadyorabouttobereadyforexaminationandtheengineer'srepresentativeshall，withoutunreasonabledelay，unlessheconsidersitunnecessaryandadvisesthecontractoraccordingly，attendforthepurposeofexaminingandmeasuringsuchworkorofexaminingsuchfoundations.第2页共2页
