中文摘要我国经济的飞速发展的同时犯罪率也在不断攀升，在案件数量不断增加的同时，司法资源却未能同步增加，案件数量的堆积使得司法压力不断增大。优化司法资源配置，简化刑事诉讼程序已经成为迫在眉睫的工作。纵观其他国家，大都通过构建刑事快速审判程序来缓解诉讼压力。我国从2014年开始开展刑事速裁程序试点工作，目的在于结合我国国情构建适合我国实际司法需要的速裁程序。在试点过程中，刑事速裁程序显示了其在提高诉讼效率方面的效果，但是也显现出其存在的诸多问题。目前为期两年的试点工作已经结束，《认罪认罚从宽试点办法》的出台肯定了刑事速裁程序试点，并在《刑事速裁办法》的基础上对速裁程序进行了细化，进一步探究如何优化我国司法资源配置。本文从介绍刑事快速审判程序的内涵与价值开始，继而对我国刑事速裁程序试点工作进行总结，并分析了刑事速裁试点工作中显现的问题；然后通过对大陆法系和英美法系代表国家的刑事快速审判程序进行分析，归纳其特点，借鉴其可适用于我国刑事速裁程序之处；最后在结合我国实际情况和借鉴域外经验的基础上，对如何构建我国刑事速裁程序提出建议。关键词：刑事速裁，轻微刑事案件，效率，公正，人权保障ABSTRACTInourcountry,theeconomydevelopsrapidlybutatthesametimethecrimerateisrising,sincethejudicialresourcesfailedtoincrease,theaccumulationofthenumberofthecasemakesthejudicialpressureincreasing.Itisurgenttooptimizetheallocationofjudicialresourcesandsimplifycriminalprocedure.Inothercountries,thepressureoflitigationisalleviatedthroughtheconstructionofthecriminalquicktrialprocedure.Ourcountryalsobegantocarryoutthepilotworkoffast-tracksentencingprocessin2014,thepurposeistoconstructthecriminalquicktrialprocedurethatissuitableforourcountrywhichsuitsactualjudicialneeds.Inthepilotprocess,thecriminalspeedprocedureshowsitseffectivenessinimprovingtheefficiencyoflitigation,butitalsoshowsitsproblems.Thetwo-yearpilotworkhasended,theissueofpleaforleniencyaffirmedthepilotfast-tracksentencingprocess.Theprovisionsofthefast-tracksentencingprocessarerefined.Thepleaforleniencyfurtherexploreshowtooptimizeallocationofjudicialresourcesinourcountry.Thisarticlebeginswiththeintroductionoftheconnotationandvalueofthecriminalspeedcuttingprogram,thensummarizesthepilotworkofthefast-tracksentencingprocessinourcountry,andanalyzestheproblemsappearinginthepilotwork.Secondly,throughtheanalysisofthecriminalquicktrialprocedureofthecontinentallawsystemandtheAnglo-Americanlawsystem,thecharacteristicsofthecriminaltrialprocedurecanbesummarized,whichcanbeusedfortheapplicationofthecriminalspeedcuttingprocedureinourcountry.Finally,onthebasisofcombiningtheactualsituationofourcountryanddrawingontheexperienceofforeigncountries,thispaperputsforwardsomesuggestionsonhowtoconstructthefast-tracksentencingprocessinourcountry.KEYWORDS:fast-tracksentencingprocess,minorcriminalcases,efficiency,justice,humanrightsprotection目录........................................................................1............................1.........................................1.........................................2.....................................2..............................................................2............................................................3................................................3..............................................4............................................4....................................................4....................................................5............................................6............
