下载后可任意编辑农地产权与人权的制度分析12024 年 6 月 23 日农民财产权的完整性的制度经济讨论周阳敏( 浙江大学 经济学院, 浙江 杭州 310027) 摘要: 本文从一个真实事例出发, 探讨了人们长期以来一直忽略但又潜意识存在的农民人权问题, 并指出这是三农问题的根本所在, 因为产权的根本和核心是收益权, 所有权只是收益权的派生——一种不同于蒲鲁东的所有权观点。而农民人权是农民财产权的应有之要义, 构成完整的农民财产权。本文认为, ”政治竞争模式”和”法律确立模式”将经过农民自动选择并渐进演化, ”潜规则”和法律的并行形成了产权”双规制”, 并从新制度经济学角度, 构造了一个动态博弈模型, 得到一条自动演化的最优路径——产权”双规制”的动态经济学方程, 从而给出一系列的政策建议: 农民自治组织与农民行业协会, 农民法律援助、 农民经济援助与农民教育援助, 农民权益保护以及乡镇的公司化、 股份化和公众化改革等等。关键词: 农民问题 财产权 完整性 ”双规制”产权 自动演化中图分类号: 文献表示码: AInstitutional Economic Research on Integrality of Property for PeasantFairtown Yangmin Zhou(School of Economics, Zhejiang University, Hangzhou 310027,P.R.China)Abstract: This paper has discussed the problem of Human Rights of peasant, which has been ignored though there exists for long time. A model of dynamic game has been set up from new institutional economics. And an equation of dynamic economics of dual-rule property rights has also been got, which is an optimization path.
