AbstractThe issues and implementations of the Regulations on Real Estate Management and Real Right Law made up the blankness of legislation on condominium management. The theory of Condominium associations is an important part of condominium management system , in the interest of all owners and the important approach through which member ownership can be realized. Therefore, this paper is established in the aspact of legal research and focuses on the basic issues of Condominium Association. Analysis of the current owners of our shortcomings, the distinction between ownership of the building for the future direction of a sound point of view the author.Key Words：condominium; condomunium associations; proprietor; house owner convention浅议业主大会业主大会是指由物业管理区域内业主代表组成，代表业主的利益，向社会各方反映业主意愿和要求，并监督物业管理公司管理运作的一个民间性组织。随着我国《物业管理条例》和《物权法》的相继颁布实施，区分所有建筑物管理立法上的空白得以弥补，但是相关法律中对于区分所有权人管理团体的立法规定仍然不尽完善。本文拟从讨论业主大会的意义入手，讨论我国关于业主大会的立法，指出并分析现有立法的不足，并就如何完善提出笔者的拙见。 一、业主大会的意义与计划经济年代由政府或企事业单位采纳行政手段进行的传统房产管理相比，物业管理作为社会主义市场经济条件下产生的一种新型管理服务体制，其最基本的特点是业主自治自律与物业管理企业统一专业化管理服务相结合。没有业主大会，缺少了物业管理的主体，物业管理就会失去生存和进展基础，也就谈不到发挥物业管理新体制和市场机制的作用和效能。因此建立业主大会，明确业主大会的法律地位，是我国建立业主自治与物业管理企业专业管理相结合的新体制的基础，也是培育和法律规范物业管理市场的必定要求。（一）有利于促进形成物业管理市场竞争机制在物业管理起步的初期，由于 业主无法自主选聘物业管理公司，往往是“谁建设谁管理”，由房地产开发公司自组或指定一家物业管理公司负责物业管理。服务好的物业管理公司无法依托其服务质量、品牌信誉接管更多的项目，形成规模...
