中 文 摘 要随 着 网 络 科 学 技 术 的 快 速 进 展 ， 虚 拟 财 产 已经 走 进 了 我 们 身 边 ， 跟 我 们 的 生 活 息 息 相 关 。但 是 由 于 我 国 目 前 对 网 络 虚 拟 财 产 的 立 法 处 于空 白 状 态 ， 使 得 网 络 虚 拟 财 产 权 纠 纷 案 件 的 审理 出 现 无 法 律 依 据 可 直 接 适 用 的 尴 尬 局 面 。 因此 ， 需 要 对 网 络 虚 拟 财 产 权 进 行 充 分 的 理 论 讨论 。 本 论 文 首 先 分 析 各 种 关 于 网 络 虚 拟 财 产 权的 学 说 和 观 点 ， 然 后 用 语 义 分 析 法 对 虚 拟 财 产权 的 内 涵 进 行 定 义 。 对 虚 拟 财 产 权 的 特 征 、 法律 关 系 的 主 体 、 客 体 进 行 分 析 阐 述 。 对 现 今 网络 虚 拟 财 产 及 虚 拟 财 产 交 易 中 存 在 的 各 种 问 题作 系 统 的 分 析 和 归 类 ， 并 根 据 收 集 到 的 资 料 展开 针 对 性 的 论 述 。 在 以 上 的 基 础 上 提 出 了 虚 拟财 产 权 在 物 权 法 和 侵 权 法 上 的 保 护 ，有 助 于 完善 我 国 的 网 络 虚 拟 财 产 权 立 法 。关 键 词 ： 虚 拟 财 产 ； 法 律 关 系 ； 立 法Abstract With the rapid development of science and technology, the virtual property has walked into the US, with our life be closely bound up.
