中文摘要WTO 争端解决机制是 WTO 法的精髓所在。它通过规定一系列较为完整、严格的审理程序和监督机制来保证世贸组织的各项实体规则得到遵守。在实践中，它已经成为公平、高效地解决成员方之间的贸易争端的重要手段。但是，它还存在着诸多不尽人意之处。许多成员方都对它提出了批判意见，主张对其进行修改。国际社会对修改 WTO 争端解决机制的谈判日益关注。本文着重对争端解决机制在制度和程序两个方面存在的缺陷与问题进行阐释，结合外国的改革意见，对完善 WTO 争端解决机制提出几点看法。关键词：WTO；争端解决机制；专家小组；上诉机构AbstractThe WTO dispute settlement mechanism is the quintessence of WTO law. It through a series of more complete and strict trial procedures and supervision mechanisms to ensure the all WTO entities rules are observed. In practice, it has become the important means to solve trade disputes between members fairly and efficiently. However, there are still many unsatisfactory points. Many members proposed their criticism and advocated to revise it. International society pay increasing attention on negotiations for modifying the WTO dispute settlement mechanism. This paper focuses on illustrating the defects and problems of system and procedures, combining the foreign reform suggestions, putting forward several opinions to perfect the WTO dispute settlement mechanism as well.Key word：WTO ；Dispute settlement mechanism； Expert group； Appellate Body论 WTO 争端解决机制的完善我国加入 WTO 已经差不多十年了，WTO 已经深化地影响到我国经贸、政策、法律乃至人们日常生活等领域。因此我国应该加强对 WTO 各项法律制度的讨论。1997 年 4月 17 日，时任 WTO 总干事的鲁杰罗先生在韩国向商界致辞时，对 WTO 争端解决机制曾经做出如下评价：“假如不提及争端解决机制，任何对 WTO 成就的评价都是不完整的，无论从何种意义上讲，争端解决机制都是多边贸易的核心支柱，同时它也是 WTO 对全球经济稳定所做出的最独特的贡献，新的 WTO 体制因而迅即变得强健有力，亦比其前身关税及贸易...
