AbstractWitness testimony is one of the most common and widely used evidence. The testimony by the witness in the court is of vital importance in our criminal justice system. However, there are some pheromones such as vague definition of the scope of witnesses or a lower rate of the testimony by the witness in the court in our country’s practice. The imperfect legal norms about witness duty is an important reason besides the ones that witness themselves have low legal consciousness and witness protection system is not perfect. This thesis will have a study on how to perfect the testimony by the witness in the court by analyzing the value and the defects of the testimony by the witness in the court in our country and the legislation and practice in other countries. Key words: the witness to testify in court ； value analysis ；legislative status；legislative ideas试论我国证人出庭作证制度随着我国刑事审判方式改革的全面开展和深化进展，证人证言在诉讼中的地位和作用将有进一步的突出，1996 年刑事诉讼法修改的一个最主要的成果就是改革了庭审方式，由纠问式转化为控辩式，强化了控辩双方在庭审中的作用，也使得庭审过程更趋于公平。但是从司法实践来看，证人大多是以提供书面证言的方式作证，这样实际上限制和弱化了证人证言这一证据的作用，同时也使得证人证言的真实性大打折扣。除此之外，我国司法实践中证人出庭作证率很低，严重影响了案件的审理并且有可能导致审判的不公正。随着我国经济社会的进展，证人证言在刑事诉讼中的作用将更加明显。一、证人出庭作证制度的价值分析证人出庭作证制度是世界司法传统和一项普遍原则。源于古典自然主义的司法听证，突出公平的价值，强调在法院审查事实和法律问题时，要以公开进行的方式听取证人和当事人的陈述；并加以充分的论证，才能确保审判的公正，从而实现法的自然主义。（一）有利于保证证人证言的真实性我国新《刑事诉讼法》第 47 条规定：“证人证言必须在法庭上经过公诉人、被害人和被告人、辩护人双方询问、质证,听取各方证人的证言并且经过查实以后，...
