Abstract At present,Punishment unimprisionment has become a main development direction in many countries in the world.Penalty applies have appeared the trends of both imprisonment and non-confinement penalty in using in some developed countries.Besides,they gradually expand the applicable scope of the non-confinement penalty.Our country's legislation technology is relative deficient.Law is imperfect.The limitation of executing system makes our country’s non-confinement penalty become more difficult and develop slowly.This article through the contrast and reference of the United States,Britain and other non-confinement penalty system countries,puts forward the advice of completing our county’s non-confinement penalty system. Consummating our county’s non-confinement penalty system,we can ease the tight of judicial resources problem and speed up the pace of change criminal policy. Key words:non-custodial sentence；confiscation of property；fine；confine 试论我国非监禁刑制度的完善2025 年 11 月 8 日，最高人民法院副院长姜兴长在第五次全国刑事审判工作会议上指出，全国各级人民法院要正确依法适用非监禁刑。我国立法技术相对粗疏、法律规定不完善、执行体制的限制使我国非监禁刑在刑事立法和司法中长期受到冷落，非监禁刑的适用步履维艰、进展缓慢。①完善我国非监禁刑制度，可以缓解司法资源紧张的问题，能够加快转变刑事政策的步伐。一、完善我国非监禁刑制度的意义（一）有利于改造罪犯对犯罪分子的社会化改造包括两方面的内容，一方面是指监狱内的犯罪分子的社会化改造，这主要是指在监狱中利用监狱的力量对犯罪分子进改造的同时，还应动援监狱之外的社会力量对犯罪分子进行改造，并为犯罪分子建立起在监狱中与社会联系的桥梁，不断提高其刑满释放后回归社会的能力。②另一方面是指在监狱外执行刑罚，将犯罪分子置于社会中，主要依靠社会的力量对犯罪分子进行改造。利用扩大非监禁刑的适用范围，可以使尽可能多的将犯罪分子免于监禁，被置于社会中进行改造，从而有利于实现对犯罪分子的社会化改造。无论是不是对犯罪人...
