论电子商务合同订立[摘要]由于电子商务的飞速发展，网上交易越来越繁荣，大大提高了人们的交易效率，节约了交易成本，不过，随着时间的流逝，也出现了一系列问题，比如电子商务交易环境混乱、交易不稳定性以及法律纠纷逐渐增加等等，究其根本，在于立法方面依旧有待于进一步完善。通过规范数据电文合同的形式，细化电子签名要求，规制格式条款效力从而规范电子商务合同订立，保护交易当事人的合法权益，促进电子商务的繁荣。[关键词]电子商务；电子交易；电子商务合同[Abstract]Due to the rapid development of e-commerce, online transactions become more and more prosperous, greatly improve the transaction efficiency, saving transaction costs, however, with the passage of time, there are also a series of problems, such as the electronic commerce environment of chaos, instability, electricity trading e-commerce legal disputes increase, the reason is I China's e-commerce legislation is still not perfect.
