论家庭暴力中女性的防卫权[摘 要] 在家庭暴力案件中受害主体往往为女性，其合法权益遭受损害，凸显了防卫权的必要性。家庭暴力中女性防卫的基本形态有言语防卫、轻微的行为抵抗和严重的暴力行为防卫等，而在防卫权的认定上存在的问题主要有证据采集困难、时间难以限定、防卫强度不易控制以及公众法律意识薄弱。因此，有必要建立积极取证和举证责任倒置的配套制度、适用受虐妇女综合症理论、增设专有罪名和增强公众和公权力机关意识,以便解决和完善家庭暴力中女性防卫权的认定问题。[关键词] 家庭暴力；防卫权；女性；正当防卫[Abstract]In domestic violence cases, women tend to be the victims, their legitimate rights and interests have been damaged, these highlight the need for defense rights.The basic defenses of women in domestic violence are verbal defense, slight action against, serious violent defense and so on. While the problems about women's defense rights in domestic violence are mainly about evidence collection difficulty, the time is difficult to limit, defense strength is not easy to control and citizens' legal consciousness is weak. Therefore, it is necessary to set a system to support gather evidence actively and reverse the burden of proof, apply the theory of abused women syndrome, increase specific accusation and strengthen the legal consciousness of citizens and government agencies.
