论警察盘查权的行使及规制[摘 要] 盘查权是法律赋予警察的基本职权，也是被最广泛行使的权力之一，对于打击犯罪、维护社会治安具有不可替代的作用。然而现今盘查权的行使存在着诸多的缺失，盘查动因不明确、盘查范围过大、存在滥用现象、缺少约束。针对这些问题，本文在此提出，应明确启动标准、限定盘查时间和地点、具体盘查措施、规范执行主体、建立健全监督制约机制，以规范盘查权的行使。 [关键词]警察盘查权；执法公信力；法治 [Abstract] The right of interrogation is the basic authority of office for police by law and is also one of the most widely exercised powers. It plays an irreplaceable role in the fight against crime and the maintenance of social order. However, there are many deficiencies in the exercise of the right of interrogation. The reasons for the interrogation are ambiguous ； the scope of interrogation is too large, and there exists abuse and lack of restraint. This paper puts forward suggestions in order to solve these problems. It should be clearly defined standards and define time and place of interrogation, making interrogation measures specially, and regulate the executive body, establish and improve the supervision mechanism to normalize the exercise of interrogation.
