题 目：论社会源危险废弃物的环境责任界定 0 摘 要危险废弃物属于固体废弃物，但其通常具有腐蚀性、毒性、易燃性、反应性和感染性等某种或多种危险特性,其中社会源危险废弃物因其独特的面源性, 会对生态环境和人类健康构成更为严重的危害或潜在威胁。清晰严格界定社会源危险废弃物的环境责任主体及其范围是落实责任的第一步。本文旨在探讨在社会源危险废弃物的法律控制中如何更好的设置政府、企业与公民的责任分担，尝试解决我国当下社会源危险废弃物处理中存在的问题。本文将在明确社会源危险废弃物的定义、特性和环境责任的基础上，分别从政府环境责任视角、企业环境责任视角、公民环境义务视角来讨论在社会源危险废弃物的法律控制中责任主体的责任应如何界定，并针对现存问题给出相应的法律制度层面的建议。关键词：社会源危险废弃物；政府环境责任；企业环境责任；公民环境义务AbstractHazardous waste is corrosive, toxic, flammable, reactivity and infectious . With its unique non-point characteristics,the source of social hazardous waste has a more serious threat to human health or potential threat. It is the first step to define various subjects’ environmental responsibility and their scope. The purpose of this paper is to discuss how to control the social source of hazardous waste by setting up the government, enterprises and citizen's responsibility ,and to solve the present problems existing in the social source of hazardous waste treatment.
