论商业秘密的法律保护[摘要]在信息网络与市场经济快速发展的环境下，信息的频繁泄露，人才的不断流动，使得商业秘密侵权案件发生的频次大大增加。虽然我国关于保护商业秘密的法律制度已经初步建立，但是制度建立时间较短，在保护商业秘密的立法上还存在不足之处。因此，探讨我国现有的商业秘密法律保护制度，借鉴国外成功的立法经验，制定专门的立法，统一我国保护商业秘密的法律，加强法律的可操作性，完善商业秘密的诉讼制度，以促进市场公平的竞争环境，健全我国的法律体系。[关键词]商业秘密；法律保护；反不正当竞争法[Abstract] In the environment of rapid development of information network and market economy, the frequent leakage of information and the continuous flow of talents make the frequency of commercial secret infringement cases increase greatly. Although the legal system on the protection of trade secrets has been initially established, but the establishment of the system is short, there are some deficiencies in the legislation to protect trade secrets.
