基于案例分析的珠三角地区劳务派遣用工难点问题研究【摘要】因为珠三角地区发展迅速,用工需求大,对于劳务派遣的应用更加频繁,但劳务派遣比较特殊,与传统的劳动法律关系不同的是劳务派遣涉及劳动者、劳务派遣单位(用人单位)和用工单位三方的权利和义务。《劳动合同法》对劳务派遣这种非典型的用工模式做出了规定,但是在现实生活中的用工问题上,由于劳动者维权意识不足、法律规定过于笼统及其他原因,导致当用人单位、用工单位和劳动者发生劳动纠纷时,常常会出现在这起纠纷案例中真正的受害者并不能够通过法律等合法渠道来维护自己本身的合法权益的问题。本论文分别站在员工和企业的角度,通过分析珠三角地区劳务派遣用工难点的案例,指出其案例纠纷中存在的问题,通过案例探讨给出完善的建议和解决办法。【关键词】劳务派遣;用工难点;案例分析 Research on Difficulties in Labor Dispatch in Pearl River Delta Based on Case Study[Abstract] With the rapid development of the Pearl River Delta region, there is a large demand for employment, and the application of labor dispatch is more frequent, but labor dispatch is relatively special.
