恶意欠薪罪的执行困境及其对策研究摘要自 2011 年恶意欠薪罪入刑以来,恶意欠薪罪在当今社会中被越来越多的人所关注,但是恶意欠薪罪执行过程中的问题也日益显露。恶意欠薪行为其本身具有极其恶劣的社会危害性,不仅仅对于劳动者的合法权益造成了极大损失,更是对当前社会和谐的氛围是一种破坏。但当前恶意欠薪罪法律法规制度已经与预期所设想的执行效果有些许脱节使得恶意欠薪罪执行面临诸多困境。基于此本文旨在通过对“恶意欠薪罪”入刑六年以来的研究来找出其执行过程中制度设计和司法实践中存在的问题,从而进一步找到更好的对策来使恶意欠薪罪真正地发挥其优势作用。关键词:恶意欠薪;拒不支付罪;困境 1RESREACH ON THE DILEMMA AND COUNTERMEASURES OF MALICIOUS WAGES CRIMEABSTRACTSince the crime of malicious wages was punished in 2011, more and more people have paid attention to the crime of malicious wages, but the problems in the implementation of malicious wages have become increasingly apparent.
