超限超载入刑法律分析

本科论文本科论文摘 要超限超载被称为“公路第一杀手”，是道路交通中的一种违法行为，具有极大的社会危害性，非常容易引起交通事故，造成人身伤亡和财产损失，影响道路通行效率。而且超载的车辆本身就会对路面、桥梁造成极大负担，缩短道路桥梁的使用年限。在大家竞相超限超载的不良环境中，交通货运市场也遭到破坏，形成恶性竞争。我国目前的治超工作是以行政为主导的，从其治理结果来看并不乐观，因此在充分考虑我国超限超载长期存在的原因之后，结合现行法律规定与执法情况，借鉴诸如德国、日本等国家的治理经验，分析超限超载入刑的必要性，将其设为危险驾驶罪，完善其他制度，以彻底解决超限超载这一顽疾。关键词：超限超载；刑法；刑事处罚；道路安全本科论文AbstractOverload is called "the first killer of highway", which is a kind of illegal behavior in road traffic.
