I摘 要由于我国城乡二元体制的存在,随着经济社会的不断发展,城市化水平的不断提高。在我国现行农村集体土地所有制下不可避免的出现了小产权房。小产权房多年来受房价影响成为不少人追捧的对象,但是由于其不合规性也成为一直困扰政府的问题,尽管我国政府不断出台相关政策明令禁止小产权房的转让,但在实际交易过程中依旧很频繁,其引发的伴生问题成为政府必须要解决的严峻问题。 小产权房的开发与销售牵涉各方利益并且错综复杂。太原是山西省的省会。由于历史和地理因素的影响,城中村分散在城市的各个区域,在这些区域,小产权房尤为突出。在太原高速发展的这些年里,小产权房趁着法律法规不完善和较为庞大的市场需求在城中村里面迅速发展,现在已经发展成一定的规模。小产权房是太原在城中村改造进程中必须要全面解决的问题,太原小产权房是否能够平稳有序的解决,关系到太原城中村改造的进程甚至关系到太原市城市化建设发展进程。本文从太原小产权房的现状入手,分析小产权房开发建设、销售、物业售后、法律监管情况,同时结合太原小产权房出现的问题及其危害,例如土地问题,耕地问题,城市规划问题,市场秩序问题等,这些小产权房所涉及的问题涉及到了社会发展的各个方面,对太原市城市的发展和国家的发展容易造成较大的影响。文章最后提出了关于解决小产权房问题的具体对策建议,从多个角度尝试提出解决问题的途径。关键词:城市化,房价,小产权房现状,小产权房问题IIAbstractDue to the existence of urban-rural dual system, with the continuous development of economy and society, the level of urbanization continues to improve.
