摘 要
随着网络技术的发展和电子商务的广泛应用，域名已成为人们日常生活和交往中不可缺少的一部分，域名具有巨大的商业价值，但是由于相关权利人对域名的认识不足、保护意识不强、滞后等原因，使域名注册及使用存在不正当的现象及对此解决的争议。本文通过对域名、域名抢注的相关知识介绍并结合案例，分析域名抢注的原因、不正当抢注的构成以及现有法规对域名不正当抢注规制的不足，从反不正当竞争的角度探讨对域名不正当抢注的法律规制。

Domain Name Improper Cyber-squatting of Rules and Regulations
ABSTRACT
Along with the development of network technology and the widespread application of Electronic-Commerce, domain name, which process a huge commercial value, has become an essential part of people's daily lives and communication. However, because some related oblige inefficient understanding of the importance of domain name, they are lack of the awareness of the protection of it, the legislation is lag behind and some other reasons, there exist some phenomenon or disputes about improper cyber-squatting or the misuse of domain name. Combining some related introduction of domain name and the cyber-squatting and some related cases, this article tries to give an over-all analysis about the reasons of the cyber-squatting of domain names, the constitution of improper registration of domain name and the shortcomings of current rules and regulations, and this article also explores the related laws from the angle of anti-improper competition.
