Abstract Nowadays, with the speed of development of human society and science and technology, the use of natural resources, environment is becoming more and more widely. Environmental problems with the high speed development of economy, such as resource scarcity worse, solid and water pollution, air pollution, noise pollution, overpopulation, environmental problems from a regional international problem rose problems. Since our only related environmental protection, but without the environment right in the face of the people said, the pollution of the environment is not sufficient to protect infringed upon. With the emergence of environmental pollution, and environmental rights theory, the mature people forward national legislation giving them the environment right. Based on the theory of environmental right at home and abroad to study abroad, and to the environment right legislation in China, this paper discusses why and how to establish the environment right by the constitution, how to establish environmental legislation system realization environmental protection of rights and how to improve the environment right litigation system.
