Abstract Nowadays, with the speed of development of human society and science and technology, the use of natural resources, environment is becoming more and more widely. Environmental problems with the high speed development of economy, such as resource scarcity worse, solid and water pollution, air pollution, noise pollution, overpopulation, environmental problems from a regional international problem rose problems. Since our only related environmental protection, but without the environment right in the face of the people said, the pollution of the environment is not sufficient to protect infringed upon. With the emergence of environmental pollution, and environmental rights theory, the mature people forward national legislation giving them the environment right. Based on the theory of environmental right at home and abroad to study abroad, and to the environment right legislation in China, this paper discusses why and how to establish the environment right by the constitution, how to establish environmental legislation system realization environmental protection of rights and how to improve the environment right litigation system. Key words：environmental problems；rights of environment；righet浅论我国环境权立法的完善随着社会的进展进步，资源匮乏、环境污染、人口膨胀等环境问题接踵而来，严重威胁到人类的生存与进展。据不完全统计，1998 年以来，我国每年的环境纠纷以超过 20%的速度增长。最近几年，这种增长的势头更加迅猛，达到了年均增长 29%。①2025 年，中国重金属污染事件频发。去年 8 月，湖南武冈市发生了因企业污染造成儿童血铅超标的事件，354 名儿童血铅“疑似超标”。几乎是同一时间，陕西凤翔也因东岭冶炼公司铅排放超标，有数百名儿童血铅超标。而同年发生的湖南浏阳镉污染事件已造成了两人死亡、500 余人尿镉超标，厂区周边土壤、农田、林地等被污染。因此可以说，环境污染一旦出现，不仅会危及到自然生态环境的健康，还...
